北京德和衡律师事务所权益合伙人陈爽爽表示，根据《联合通函》等相关规定，虚拟资产相关产品的销售必须符合相关司法管辖区的要求，即虚拟资产现货ETF禁止向中国内地投资者销售。而中国内地的法人或自然人，在未事先获得中国内地所有必要的政府批准的情况下，也不得直接或间接购买比特币ETF。
