Federal Judge Jia Cobb of the District of Columbia has issued a formal opinion, ruling that the US Commodity Futures Trading Commission (CFTC) does not have the authority to conduct a "public interest review" to prevent Kalshi from listing on the US political prediction market. Judge Cobb noted that Kalshi's contracts do not involve illegal activities or gambling, but are about elections, neither of which fall under the jurisdiction of the CFTC. Currently, the US Congress has revoked the CFTC's public review of certain proposed futures contracts, saying that unless the contracts fall under a specific category such as terrorism or gambling.
