Ripple's chief legal officer, Stuart Alderoty, spoke in an interview Thursday about the possibility of the Securities Exchange Commission appealing the final ruling in Ripple's XRP case.
"If the SEC were a rational actor, they would have gotten out of this case," Mr. Alderoty said, underlining the court's conclusion that "there are no victims here, no one has suffered any losses in this case, no allegations of fraud". "There is nothing in this case that advances the core mission of the SEC," he stressed.
However, Ripple's chief legal officer cast doubt on the securities regulator's rationality, noting: "But we all know that the Securities Exchange Commission has proven itself to be irrational when it comes to cryptocurrencies." He added: "In our case, the court criticized the Securities Exchange Commission for engaging in litigation games and tactics rather than faithfully applying the law."
