CLARITY Draft Would Block Inactivity Claims on Self-Custodied Bitcoin

The latest CLARITY draft would prevent inactivity-based ownership claims over self-custodied digital assets as Noah Doe and two companies seek title to 3.799 million BTC. According to NS3.AI, Section 20216 says lawfully self-custodied assets cannot be treated as abandoned, unclaimed, forfeited, or subject to finder’s title solely because an owner has not moved them.

The draft would still preserve state unclaimed-property rules for custodial holdings kept at exchanges, brokers, and custodians. The provision remains subject to Senate negotiation and to how a court interprets evidence beyond wallet silence.
