White House Finds New Tariff Path That Recovers About 60% Of Struck-Down Revenue

According to Axios, the White House has identified new legal ways to keep tariffs in place after the Supreme Court struck down its emergency tariff regime, but the replacement duties would recover only about 60% of the lost revenue, according to the Committee for a Responsible Federal Budget. The group estimates the administration's latest tariff actions would raise about $105 billion a year and about $950 billion through 2036, compared with $1.7 trillion from the broader emergency tariffs, leaving a gap of roughly $825 billion. The new tariffs, imposed under Section 301 of the Trade Act of 1974, generally carry lower rates and include more carveouts than the old regime, including exclusions for energy products. The White House said the timing of the new tariffs was intended to provide continuity and predictability for businesses rather than replace the invalidated duties. The Treasury Department is still unwinding the old tariffs, and net customs receipts fell to negative $25.6 billion in June as refund checks to importers outpaced new tariff collections.
