Justice Department Seeks First Use Of Alien Terrorist Removal Court

According to Axios, the U.S. Justice Department has asked the never-before-used Alien Terrorist Removal Court to approve the removal of an unnamed noncitizen, marking the first filing in the court’s 30-year history. Chief Judge Joan N. Ericksen heard arguments Thursday and ordered the government to provide more facts and legal analysis by Wednesday after questioning the link between the person’s alleged conduct and the law. The one-page filing did not identify the person, the alleged conduct or the specific provision of the anti-terrorism law cited. Congress created the five-judge court in 1996 for cases in which standard immigration proceedings could expose classified information. The law allows the government to keep much of its evidence secret, requires an unclassified summary for the person facing removal, and permits the use of illegally obtained evidence.
