CME sues CFTC over approval of Kalshi’s first U.S. perpetual futures product

CME Group sued the Commodity Futures Trading Commission on Thursday, seeking to vacate the agency’s approval of Kalshi’s first U.S. perpetual futures contracts and related self-certified products. The suit alleges the CFTC failed to properly analyze whether Kalshi’s Bitcoin perpetual should be treated as a “swap” under Dodd-Frank rather than a “future,” according to CoinDesk, and claims the agency “rubberstamped” the application. CME argues perps could harm its long-dated futures business.
