The US Department of Justice asked a federal court to dismiss a Clean Air Act lawsuit brought by the National Association for the Advancement of Colored People (NAACP) against xAI. According to BeInCrypto, DOJ argued that shutting xAI’s gas turbines powering its Colossus 2 data center near Memphis, Tennessee, would threaten national, economic, and energy security.
The NAACP sued in April, alleging xAI ran 27 turbines in Southaven, Mississippi, without proper permits. DOJ’s filing cites a declaration from Defense Department chief digital and AI officer Cameron Stanley saying Grok is one of four models cleared for Secret and Top Secret networks and tied to recent US military operations, including strikes against Iran.
