The U.S. Congress is advancing efforts to establish a formal regulatory framework for digital assets. The Senate Banking Committee has moved the Clarity Act forward with bipartisan support, and the bill is preparing for a vote by the full Senate.
A key component of the legislation is the Blockchain Regulatory Certainty Act (BRCA). The provision states that individuals who only write open-source software, run nodes, or help validate transactions, and who have never taken custody or control of others’ funds, should not be treated as money transmitters under federal law.
