Kalshi’s launch of CFTC-regulated crypto perpetuals has reignited debate over whether the contracts should be classified as futures or swaps. John Lothian, publisher of John Lothian News, said perpetuals resemble swaps because funding-rate mechanisms create recurring bilateral cash-flow payments, while Kalshi head of exchange analytics Udesh Jha argued they function like futures because they are exchange-traded, centrally cleared and track spot markets, according to CoinDesk. The classification could affect access, retail participation, tax treatment and oversight, with both sides also disputing manipulation risks tied to funding-rate calculations.
