The defense team of Tornado Cash co-founder Roman Storm has filed a series of new documents seeking to dismiss the trial against Storm before it begins, arguing that prosecutors overstepped their authority in their final pretrial motion.
After the government responded to Storm's motion to dismiss the trial, its defense team filed a response again last Friday, arguing that the case against him should be dismissed on the grounds that the government did not take sufficient steps to prove Storm's active participation in the crimes alleged in the indictment. "In fact, as the government acknowledges, when criminals begin to abuse the Tornado Cash protocol, it is immutable and available to anyone with an internet connection," the motion states.
