A US court has ruled that Coinbase cannot force the Securities Exchange Commission (SEC) to create new rules.
In an opening address filed with the Third Circuit Court of Appeals, Coinbase said the appeals court should direct the Securities Exchange Commission (SEC) to begin a long-delayed rulemaking process.
Coinbase said the Securities Exchange Commission violated the Administrative Procedure Act, which governs how federal agencies make and issue rules, because it did not make rulemaking and did not detail why it rejected Coinbase's rulemaking petition.
