Prediction market platform Kalshi, which lost a preliminary injunction blocking Nevada regulators on the eve of Thanksgiving, is seeking to block state regulatory action pending an appeal. The court's revocation of the injunction means Kalshi faces potential legal risks if it continues to operate in Nevada. Similar to Polymarket, Kalshi offers prediction contracts covering sports, politics, crypto and traditional markets. It believes it can operate in all 50 states with a CFTC license, but some state regulators - notably Nevada - disagree.
After the injunction was lifted, Nevada regulators said they would not immediately begin enforcement proceedings until a court decides whether to grant a stay, but that did not amount to an administrative waiver issued by the court. The court gave state regulators until Dec. 8 to respond to Kalshi's application, and Kalshi has until Dec. 12 to file a response.
