The Trump administration on Wednesday asked the Supreme Court for a quick decision on whether he has the authority to impose broad tariffs under a law designed for use during emergencies, according to an NBC coverage.
The Justice Department is appealing an Aug. 29 ruling by the U.S. Court of Appeals for the Federal Circuit that said Trump overstepped his authority, the documents said. The documents, filed by the Justice Department and the challengers, have not yet been formally filed by the Supreme Court. Jeffrey Schwab, an attorney at the Center for Liberty Justice, which is representing businesses in their challenge to the tariffs, said in a statement that he was confident the court would rule against the president.
The administration filed two documents: an appeal and a motion to expedite the hearing. In the latter, the federal attorney general, D. John Saul, asked the justices to speed up the hearing so that oral arguments could be held as early as the first week of November. That means the Supreme Court has until next week to decide whether to accept the case. A spokesperson for the Center for Liberty of Justice said the challengers had agreed to that timetable.
There are also reports that the Supreme Court will take up the case and issue a ruling in the summer of 2026.
