According to foreign media, Trump Cabinet officials told the Federal Circuit Court of Appeals on Friday that if it were to rule that Trump's global tariffs are illegal, it would seriously damage U.S. foreign policy. Treasury Secretary Bescent warned that it would bring "dangerous diplomatic embarrassment." The White House filed statements from Bescent, Commerce Secretary Lutnik, and Secretary of State Rubio in the Federal Circuit Court of Appeals in Washington. The court is expected to rule soon on whether Trump exceeded his authority to impose tariffs under the 1977 Emergency Powers Act. During oral arguments on July 31, the judge was skeptical of the administration's claim to have broad tariff powers, suggesting it may back a challenge filed by a coalition of small businesses and Democratic governing states. Several cabinet ministers said a ruling that the tariffs were invalid would overturn months of negotiations with the European Union, Japan, South Korea and others. "Suspending the effectiveness of the tariffs would expose the United States to the risk of retaliation from other countries because they would perceive the United States as lacking the ability to respond quickly to retaliation," Mr. Bessant said.
