After the Tornado Cash case, a US Justice Department official said that simply writing non-malicious code is not a crime

Matthew Galeotti, acting assistant attorney general in the criminal division of the Department of Justice, said at the American Innovation Project event that "just writing code without malice is not a crime". He stressed that the Justice Department would continue to prosecute crimes involving fraud, money laundering and sanctions evasion, but would not impose a new regulatory framework for the crypto industry through criminal law.
The statement, which comes just weeks after Roman Storm, founder of Tornado Cash, was convicted of operating a money transfer business without a licence, sparked calls in the industry over whether the charges should be dropped. The shift in the Justice Department's position is seen as related to the new Trump administration's policy on digital assets.
