Prosecutors in Tornado Cash case cite false information to prove "criminal consciousness"

On July 14, the US Attorney for the Southern District mistakenly attributed a Telegram message asking "how to cash out $600 million" to the development team during the pretrial hearing of Roman Storm, a developer of Tornado Cash, to prove its "guilty mind". Defense documents show that the message was actually written by a CoinDesk reporter and forwarded to the Tornado Cash group by Alexey Pertsev. The prosecution admitted that the original provided chat logs did not show a "retweet" tag leading to the misunderstanding, but said a corrected version had been provided in December 2024. The Storm defense team asked for the exclusion of all Telegram evidence from Pertsev's phone and questioned the integrity of the grand jury process. Pertsev has been sentenced to 64 months in prison by a Dutch court for assisting in money laundering.
