Department of Justice rejects motion for criminal charges against Tornado Cash developer Roman Storm

Golden Financial Reports The Department of Justice on Friday denied a motion by Tornado Cash developer Roman Storm to dismiss the criminal charges, saying the defense documents present disputed facts that should be weighed by a jury, rather than arguments appropriate for an earlier-stage motion. The Department of Justice previously accused Storm of conspiring with associate Roman Semenov to launder money, operate an unlicensed money transfer business, and violate sanctions laws by creating and operating Tornado Cash, a crypto hybrid service designed to trade anonymously, while also accusing North Korea's Lazarus Group and other criminal entities of laundering money through Tornado Cash.
Lawyers for Roman Storm filed a motion to dismiss the complaint in late March, arguing that Tornado Cash was not a managed hybrid service and did not meet the definition of a "Financial Institution Group" and that Roman Storm could not control the service or prevent organizations like Lazarus from using it. In Friday's filing, the Department of Justice challenged the defense's description of Tornado Cash, saying it was declared a mixer in 2019 and that the entire service included a website, user interface, a set of smart contracts and a "network of repeaters."
