Mr. Musk has widened his court battle with OpenAI by demanding documents from Helen Toner, a former OpenAI board member who was the point person in last year's "palace fight" that led to the brief dismissal of Altman, OpenAI's chief executive. Mr. Musk, one of OpenAI's earliest investors, demanded that Mr. Toner turn over documents and communications related to her decision to leave the OpenAI board and replace and reinstate Altman, according to a Washington, D.C., Superior Court filing. The subpoena requires Mr. Toner to turn over information by May 21, 2024. The demand relates to a lawsuit Mr. Musk filed last month against OpenAI and Altman, alleging that a multibillion-dollar partnership between OpenAI and Microsoft, its biggest investor, violated the company's original promise to build artificial intelligence for the benefit of all humanity. OpenAI called Mr. Musk's claim a "history correction" aimed at promoting Mr. Musk's own artificial intelligence company.
