Coinbase recently obtained and made public a batch of internal communications from the Securities Exchange Commission (SEC) through the Freedom of Information Act (FOIA), which revealed that the New York State Attorney General's Office asked the SEC to explicitly recognize Ethereum (ETH) as a security during the 2023 lawsuit against KuCoin.
Shamiso Maswoswe, director of the New York Investor Protection Bureau, said in a letter that he hoped the SEC would file an amicus curiae opinion to support the view that ETH is a security in order to strengthen investor protection. However, the SEC ultimately rejected the request, but the document revealed the regulator's internal discussions on the qualitative issue of ETH, especially after Ethereum switched to a PoS consensus mechanism. Coinbase said the disclosure was designed to increase regulatory transparency and promote public understanding of crypto asset regulatory policies.
