The US District Court for the Western District of Texas has ruled that the Treasury Department's Office of Foreign Assets Control (OFAC) sanctions against Tornado Cash were illegal and permanently banned it from imposing sanctions on the mixer, marking the end of a two-year legal battle in favour of the privacy parties.
Although OFAC voluntarily removed Tornado Cash from the sanctions list in March 2024, Judge Robert Pitman noted its intention to retain future sanctions and stressed that "the Fifth Circuit's ruling requires enforcement," according to court documents. Lawyers for the six plaintiffs in the case had accused OFAC of trying to evade judicial review through technical maneuvers.
It is worth noting that two developers of Tornado Cash, Roman Storm and Roman Semenov, still face criminal charges from the Department of Justice, which is still on the OFAC sanctions list. The ruling is only for the agreement itself and does not involve judicial proceedings against the developers.
