Fox Business Correspondent Eleanor Terrett revealed that the SEC will respond to Coinbase's appeal request on February 14. Previously, Judge Failla had granted Coinbase an interlocutory appeal over whether its platform's digital assets were subject to existing securities laws.
The SEC currently faces four options: one is to oppose the appeal request and continue the Gensler-era position, arguing that securities laws clearly apply to most crypto tokens, even though current Acting Chairperson Uyeda and Commissioner Peirce have both stated that the law in this area is not clear; the second is not to oppose the appeal, indicating a willingness to resolve the applicability of securities laws through the crypto working group; the third is to apply for an extension; and the fourth is to choose to withdraw the lawsuit.
The SEC's decision will be an important indicator of its stance on crypto regulation under the new leadership.
