Lawyers representing Binance and former CEO Changpeng Zhao filed a motion on Monday to dismiss an amended complaint filed by the Securities Exchange Commission last month. Stressing that even if some buyers want crypto assets to appreciate in value, this does not mean that all transactions involving crypto assets should be considered securities transactions. The filing said the Securities Exchange Commission refused to spell out any criteria in determining which crypto asset transactions qualify as investment contracts.
